1. Who may use Sovya

Sovya is intended only for users in India: people who are physically located in India and who use the service from India. It is not offered to, marketed to, or intended for residents or users in the United States or any other country.

By using Sovya you represent that you are in India, that you are at least 18 years old, and that you are not using the service on behalf of a person or organisation outside India. If that is not true, do not use the service. We may refuse, geoblock or delete access from outside India without notice.

Access from the United States or any other non-Indian location is unauthorised. It does not create a US customer relationship, a US offer, or any right under US consumer, privacy or product-liability law beyond what a court would apply of its own force.

2. Beta, volunteers, your risk

Sovya is a pre-release beta. It is not a generally available product. Access is limited to people in India who choose to test it as unpaid volunteers. There is no paid subscription, no customer contract for consideration, and no service-level commitment.

You use Sovya entirely at your own risk. Features may be wrong, incomplete, unavailable, changed or withdrawn at any time without notice. Do not use the beta for production work, regulated decisions, or anything you cannot afford to lose.

3. Who these terms protect

“Sovya”, “we” and “us” means the operators of sovya.ai and every person or entity involved with the service: founders, directors, officers, employees, contractors, advisors, volunteers, affiliates, licensors, hosting and model providers, and their successors.

To the maximum extent Indian law allows, none of those people or entities has any liability to you arising out of the beta or these terms, except as stated in section 7.

4. The service is not advice

Sovya is an AI assistant. It generates text and can be confidently wrong, incomplete or outdated. It is not legal, medical, tax, financial, investment, accounting, engineering or other professional advice. You must independently verify anything consequential before you act on it. You alone are responsible for how you use the output.

5. No warranty

The service is provided “as is” and “as available”, with no warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, non-infringement, or uninterrupted or error-free operation. We do not warrant that defects will be corrected or that the service is free of harmful components.

6. No liability (what we exclude)

To the maximum extent permitted by the laws of India, Sovya and every person involved with sovya.ai shall have no liability whatsoever to you or any third party for any loss, damage, cost or claim, whether in contract, tort (including ordinary negligence), statute or otherwise, including direct, indirect, incidental, special, consequential, exemplary, punitive or lost-profit damages, loss of data, loss of goodwill, business interruption, or the cost of substitute services, even if advised that such loss was possible.

Volunteer access is free of charge. You have paid nothing. Under section 2(42) of India’s Consumer Protection Act, 2019, “service” does not include a service rendered free of charge. This beta is therefore not offered as a paid consumer service, and there is no purchase price that could be refunded.

7. What we cannot exclude

Nothing in these terms excludes or limits liability that the law of India does not allow us to exclude or limit, and if a court will not allow a total exclusion our remaining liability is limited to the smallest amount that court must allow.

8. Indemnity

You will defend, indemnify and hold harmless Sovya and every person involved with sovya.ai from any claim, loss, liability or expense (including reasonable legal fees) arising from your use of the beta, your content, your breach of these terms, your use from outside India, or your violation of law or of another person’s rights. This indemnity does not require you to cover our fraud or willful misconduct.

9. Acceptable use

Do not use Sovya to break the law of India or any other law that applies to you; to generate content that harms, exploits or harasses people; to attempt to extract system instructions or bypass safety guardrails; to probe, scrape or overload the service; or to submit other people’s personal data without a lawful basis under the DPDP Act or other applicable law. We may suspend or delete an account at our sole discretion, with or without notice.

10. Your content and feedback

You retain whatever rights you already have in prompts you type. You grant us a licence, limited to operating and improving this India beta, to process that content. Feedback you send may be used without restriction or compensation. How personal data is handled is described in the privacy notice. Statutory DPDP rights are not waived by that licence.

11. Fair usage and availability

Accounts have per-minute and daily limits. Automated or bulk access is not permitted without prior written agreement. We may change, throttle or discontinue any feature at any time. There is no uptime commitment and no remedy for downtime.

12. Accounts

Sign-in uses Google. You must use an account you are authorised to use. You are responsible for activity under your session. We may refuse, limit or revoke access, including at the end of the beta or if we reasonably believe you are outside India.

13. Third-party infrastructure

The beta runs on third-party infrastructure, including Amazon Web Services and model providers. Those parties have their own terms. Processing may occur in AWS regions outside India where a model is not offered in Mumbai; that is stated on the site and in the privacy notice. We are not responsible for those parties’ acts, omissions, outages or changes.

14. Changes

We may update these terms at any time by posting a new version on this page. Continued use after a new version is posted is acceptance of that version. A new version invalidates a previous in-browser acceptance and you will be asked to accept again before signing in.

15. Governing law and disputes

These terms are governed by the laws of the Republic of India, without regard to conflict-of-law rules that would point to another country (including the United States). Courts in India have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect the service.

You agree not to bring a claim in a US court. If one is brought anyway, you agree that Indian law still governs the contract, that you were not an intended US user, and that any US mandatory rule applies only to the minimum extent that court requires.

16. Entire agreement

These terms and the privacy notice are the entire agreement for the beta. If a provision is held unenforceable, the rest remains in effect and the invalid provision is modified to the minimum extent required. Our failure to enforce a provision is not a waiver.
